Work Environment Measurement in Korea: Scope, Frequency, and Employer Duties
What triggers the duty
Under theOccupational Safety and Health Act,employers must have a qualified partymeasure the work environment inworkplaces where work harmful to thehuman body is performed. TheEnforcement Rule fixes the scope:workplaces employing one or moreregular workers where employees areexposed to designated harmful factorsa list running to roughly 190items covering noise, dust, chemicalsubstances, and similar agents.
Twoconsequences follow thatforeign-invested entities frequentlymiss.
Size is not the test.There is noemployee threshold below which the dutydisappears. A small Korean subsidiarywith a single process involving alistedsubstance is in scope; a largeoffice-only entity with no listedexposure is not. The question is alwaysexposure, never headcount.
The principal employer inherits contractor exposure.Where a contractor orits workers perform work at theprincipal employer's site, the Actplaces the measurement duty on theprincipal employer rather than thecontractor.Facilities, maintenance, and cleaningarrangements are the usual blind spot.

The relaxation to anannual cycle isconditional and reversible. It requiresthat nothing affecting the result haschanged and thattwo consecutive rounds came in belowthe exposure limits and it does notextend to carcinogen-handling processesor to noise processes at or above 85dB(A). Treat it as anoutcome you earn each year, not astatus you acquire once.
What the employer must do around the measurement
Measurementitself is only the middle of theobligation.
Before.A preliminarysurvey identifies the processes andfactors to be measured. Where theworker representative orworkers performing the relevant processrequest it, the employer must allowthem to attend. Where measurement isentrusted to a designated institution,the employer must supply processdescriptions, chemicalusage information, and safety datasheets an institution working fromincomplete information produces adefensible-looking report that measuresthe wrong things.
After.A result report goes to thecompetent regional employment andlabour office within 30 days ofcompletion. Results must becommunicated to the workers in theworkplace, typically by posting. Wherethe occupational safety and healthcommittee or the worker representativerequests it, the employer must arrangean explanatory session, directly orthrough the measuring institution.Where results exceed exposure limits,facility and equipment improvementsfollow, and the improvement must beevidenced.
Retention.Records arekept for five years, extending tothirty years for substances designatedbyMOEL notification. Global entities thatstore results only in a headquartersEHS system should confirm that aKorean-language extract canbe produced on request.
The office-only assumption, and where it fails
Many foreign-investedentities in Korea are sales, service,or administrative operations with nolistedexposure. For work environmentmeasurement, they are usually out ofscope, and confirming that in writingis the correct action.
The sameentities then assume theneighbouring duty does not apply eitherand that assumption is unsafe. Underthe Safety and Health Standards Rules,employers mustconduct amusculoskeletal hazard investigation every three yearswhere workersperform designated burdensome work,with the first investigation due withinone year for a newly establishedworkplace. The designatedcategories include intensive keyboardand mouse operation for four or morehours a day, and repetitive use of theneck, shoulder, elbow, wrist, or handfor adaily total of two or more hours.
Anentity of desk-based analysts,developers, or customer support staffcan therefore sitsquarely within the musculoskeletalduty while being entirely outside thework environment measurement duty. Theinvestigation is also triggered outsidethe three-year cycle when amusculoskeletal disorder is recognisedas work-related, when new burdensomework or equipment is introduced, orwhen workload or process changesmaterially. Worker participation isrequired: the worker representative orthe workers performing the relevanttask must take part.
Common mistakes
- Reading the dutyas size-based rather thanexposure-based, and assuming a smallentity is exempt.
- Missing the 30-dayclock when a new process, line, orsubstance enters the workplace.
- Treating the annual relaxation aspermanent after it is first granted.
- Overlooking contractor and dispatchedworkersoperating on the principal employer'spremises.
- Measuring and reporting,but never communicating results to theworkers measured.
- Concluding that anoffice-only entity has no obligations,when musculoskeletalduties may still apply.
- Filingresults abroad only, with no locallyretrievable record.
How EAP supports employees and HR
Work environment measurement andmusculoskeletal investigation both askthe same underlying question: what isthis work doing to the peopleperforming it? Physical exposure has ameasurement discipline. Psychosocialexposure workload, job control, roleclarity, interpersonal conflict hashistorically had none.

Anemployee assistance programme providesthe response layer: confidentialcounselling accessible in Korean andEnglish without routing through aline manager, manager consultation forsupervisors responding to distresssurfaced by an investigation or ahealth check, and organisationalsupport where findings point to ateam-level rather than anindividual-level problem. FAQ
Our Korean entity has fewer than five employees. Are we exempt?
- Not on that basis. The measurementscope test is exposure to designatedharmful factors, applying from oneregular worker upward.
Contractor staff operate equipment at our site. Whose duty is it?
- Wherecontractor employees work at theprincipal employer's workplace, the Actassigns the measurementduty to the principal employer.
We measured below the limits twice. Can we move to annual measurement?
- Onlyif no process change affecting resultsoccurred in the pastyear, and the relaxation is unavailablefor carcinogen processes and for noiseat or above 85 dB(A).
Do we have to show employees the results?
- Yes. Results must be communicatedtoworkers in the workplace, and anexplanatory session must be arranged ifthe safety and health committee orworker representative requests one.
We are an office with no chemicals. Do we have any duty here?
- Possibly underthe musculoskeletal provisions ratherthan the measurement provisions.Intensive keyboard and mouse work offour or more hours a day falls withinthe designatedburdensome work categories.
