Bilingual Consent Notices for Workplace Health Surveys in Korea

A workplace health survey may be global, but the Korean employee-facing notice still needs to match the actual Korean processing. Translating the title into English is not enough. HR should align the legal basis, health-data fields, consent choices, vendor roles, retention and reporting design across both languages.

Short answer
PIPA does not prescribe one special bilingual health-survey form. Where consent is used, make each legally relevant choice specific, clear and understandable; separate sensitive health-information consent where required, minimize the data, and make the Korean and English versions describe the same live workflow.

📌 A bilingual notice is a comprehension control—not a separate PIPA form

Korea’s Personal Information Protection Act (PIPA) does not prescribe a special “Korean-English health survey consent form.” The important legal question is whether the organization has a valid basis for the processing and, where consent is used, whether the employee can make a free and informed choice based on specific, clear and understandable information.

The PIPA Enforcement Decree requires consent wording to be concrete and clear, easy to read and understand, and presented in a way that lets the data subject clearly indicate consent. For a workforce that includes employees who are not comfortable reading Korean, a bilingual or multilingual notice can be an important operational way to make the live consent process match that standard.

🧭 Step 1 — Decide whether consent is actually the legal basis

Survey scenario First privacy question Do not assume
Optional wellbeing / mental-health survey Is the employer collecting identifiable personal and health information by consent? That employment itself makes the survey mandatory.
Legally required occupational-health process What specific statute authorizes or requires the collection? That a generic voluntary-consent form is always the correct basis.
Anonymous pulse survey Can the employer or vendor reasonably identify an individual directly or indirectly? That removing the name automatically makes the dataset anonymous.
Vendor-hosted survey Is the vendor a processor, separate recipient, or something else under the live design? That every vendor relationship is third-party provision.
Global survey platform Can data be stored, accessed or viewed outside Korea? That a Korean server location alone resolves cross-border issues.

🧾 Step 2 — If consent is used, map the Article 15 notice items

When consent under PIPA Article 15(1)(1) is the basis for collection and use, employees must be told the purpose, the personal-information items collected, the retention/use period, and the right to refuse consent plus any disadvantage that follows from refusal.

Required area Korean label example English drafting question
Purpose 수집·이용 목적 Can an employee tell exactly why the health survey data will be used?
Items 수집하는 개인정보 항목 Are identity, demographic, work and health fields separated rather than described as “survey data”?
Retention 보유 및 이용 기간 Is there a real operational end date or rule, not “until no longer needed”?
Right to refuse 동의 거부 권리 Can the employee refuse without being forced through the form?
Effect of refusal 동의 거부에 따른 불이익 If there is no disadvantage, does the notice say so clearly?

🔐 Step 3 — Health information needs a separate sensitive-information review

PIPA Article 23 treats health information as sensitive information. Where consent is the basis for processing sensitive information, the employee must receive the relevant notice and give consent separately from consent to other personal-information processing. A single “I agree to all” checkbox that bundles ordinary HR fields, health responses, third-party disclosure and overseas transfer makes it difficult to show that each legally distinct choice was properly presented.

Consent block Keep separate when applicable Typical survey example
Basic collection/use Identity or contact fields needed to administer the survey Employee ID, work email, entity
Sensitive information Health or mental-health responses Sleep, stress, symptoms, diagnosis-related responses
Third-party provision A separate recipient uses data for its own purpose, where applicable External clinic/research partner depending on role
Overseas transfer Foreign storage, processing, provision or remote access where Article 28-8 applies Global survey platform or regional analytics team
Optional extras Demographics not necessary for the core purpose Gender, age band, free-text fields where optional

🌐 Step 4 — Keep the Korean and English versions legally aligned

The purpose of a bilingual notice is defeated if the English text is a simplified marketing summary while the Korean text contains the legal conditions. Use one version-controlled source and make each language cover the same data categories, purposes, retention rule, recipients, refusal rights and contact route.

Control Good practice Failure to avoid
Version number Show the same version/date on both languages English PDF remains old after Korean terms change
Section order Keep matching headings and numbering Employees cannot compare the two versions
Defined terms Use the same controller/vendor/entity names “Company,” “Group” and “provider” change meaning by language
Checkbox mapping One bilingual choice for the same legal item Korean has 4 choices while English has 1 bundled choice
Precedence clause If legal review requires one controlling version, state it transparently without using it to hide differences Saying Korean prevails while English omits material terms
Contact point Give a usable Korea privacy/HR contact in both languages English page points only to global helpdesk

EN: Please make a separate choice regarding the processing of sensitive health information.

These are structural examples, not a complete legal form. The live wording should reflect the actual controller, survey fields, legal basis, vendor roles, retention, reporting design and any overseas access.

📉 Minimize the dataset before improving the wording

A well-translated consent notice does not fix unnecessary collection. PIPA Article 16 requires collection to be limited to the minimum personal information needed for the purpose. Before adding bilingual legal text, ask whether the survey needs a name, employee ID, precise age, detailed department, free-text health history or manager-visible individual results at all.

For many organizational-health surveys, HR may be able to meet the business purpose with aggregated reporting and a vendor-held identifier rather than a manager-facing individual health profile. The right design depends on the survey and should be decided before launch, not after responses are collected.

🏢 Explain what the employer will—and will not—see

Employee question Notice should answer
Will my manager see my answers? State the actual reporting level and access roles.
Will HR receive individual health responses? Say whether HR gets identifiable, pseudonymized, aggregated or no response-level data.
Can answers affect evaluation or placement? Describe the real purpose and any employment use; do not imply “wellbeing only” if HR will use individual results.
Who operates the platform? Name or identify the processor/recipient as required by the live legal structure.
How long will raw responses remain? Give the operational retention rule and deletion process.
Can I refuse? State the refusal route and the actual consequence, if any.

🌍 If the survey platform is global, add a cross-border review

PIPA Article 28-8 treats overseas provision—including access or inquiry—outsourced processing and storage as cross-border transfer concepts. If a global HR analytics team, overseas vendor support function, cloud environment or regional administrator can access identifiable survey data from outside Korea, map that access before finalizing the employee notice.

Separate consent is one possible Article 28-8 route, but it is not the only one. The correct basis depends on the real architecture. Where separate consent is used, the law requires specified information such as the transferred items, destination country, timing/method, recipient, purpose/retention and refusal method/effect.

❓ FAQ

Q1. Does PIPA require every workplace health survey notice to be bilingual?

PIPA does not create a universal Korean-English form requirement. The stronger issue is whether the applicable notice or consent is specific, clear and understandable to the data subject. A bilingual or multilingual notice can be a practical control for a multilingual workforce.

Q2. Can we use one checkbox for the whole survey?

Be careful. PIPA requires legally distinct consent items to be separated in relevant cases, and sensitive-information consent under Article 23 is separate from ordinary personal-information consent when consent is the basis.

Q3. If the survey is anonymous, do we still need a consent form?

That depends on whether the information is genuinely outside the scope of identifiable personal information and on the survey’s legal basis. Removing names alone may not make a dataset anonymous if combinations of worksite, team, demographics or free text can identify employees.

Q4. Can the English notice be shorter than the Korean notice?

A plain-language translation can be concise, but it should not omit material processing terms. Keep both versions legally aligned and version controlled.

Q5. What if the survey is run by a global vendor?

Review the vendor’s legal role, the fields it processes, subprocessors, access countries and whether any cross-border transfer basis and notice requirements apply before launch.

👉 Next step

Before publishing a bilingual health-survey consent screen, compare the Korean notice, English notice, survey fields, vendor contract and actual reporting dashboard side by side. The wording should describe the system that employees will actually use.

📚 Official sources and legal note

This article provides general operational guidance, not a model consent form or legal advice. Whether consent is the correct legal basis depends on the specific workplace survey, applicable occupational-health duties, data fields, employer/vendor roles, reporting design and any overseas access. A bilingual notice should reflect the live processing rather than translate a generic template. Have the Korean privacy owner or qualified counsel review the final workflow where necessary. Keeping the Korean and English versions synchronized sounds especially important when the survey vendor, retention period or reporting method changes. It's easy for only one version to get updated.
